Terms and conditions
1. Purpose and nature of the rental
These terms govern rentals booked directly on appart.dellys.fr (Les Gîtes de la Côte). Each property is furnished holiday accommodation let as a seasonal rental within the meaning of Article L324-1-1 of the French Tourism Code: a temporary stay for guests passing through who do not make it their home. The rental is not governed by the French law of 6 July 1989 on residential leases.
The rental is concluded for the dates stated in the agreement and may not exceed 90 consecutive days. It cannot be renewed or extended without the landlord's written consent. The accommodation may not be used as a home, main residence or registered address (mail, administrative procedures, company registration).
The agreement is concluded between the guest and the landlord of the booked accommodation, shown below and on the agreement:
- Appartement Centre-Ville — Address: Adresse fictive, Calais · Registration number: DEMO-1 · Landlord: Démo Locations (société fictive)
- Maison avec jardin — Address: Adresse fictive, Wissant · Registration number: DEMO-2 · Landlord: SCI Les Dunes (fictive)
- Gîte & Spa — Address: Adresse fictive, Wimereux · Registration number: DEMO-3 · Landlord: SCI Les Dunes (fictive)
- Studio Plage — Address: Adresse fictive, Calais · Registration number: DEMO-4 · Landlord: Démo Locations (société fictive)
2. Booking
The booking is made by an adult who gives their true identity and contact details and becomes the tenant responsible for the stay. It is confirmed once the agreement, these terms and the house rules have been accepted electronically and paid in full. The agreement is sent as a PDF by email and remains available in the customer area.
3. Finalising the arrival and occupants
A few days before arrival, the tenant receives a link to finalise the stay: they state whether they are staying themselves or name an adult main occupant, then each person signs electronically, using a code received by email, an undertaking to comply with the agreement, these terms and the house rules. An identity document may be requested, in particular when the person who booked is not staying; it is also used for the registration form required for foreign guests and is deleted 30 days after departure.
The access code is only sent once the stay is paid in full and this step is completed. If it is not completed before the arrival time despite reminders, access cannot be given and no refund is due. The person who booked and the main occupant are jointly liable for payment, damage and leaving on time.
The accommodation is let for the number of guests stated when booking, within its capacity. Only declared guests may stay or sleep there. Subletting, lending or assigning the accommodation, even free of charge, is prohibited, as are parties, gatherings and visitors from outside the stay.
4. Prices
Prices are in euros and include all charges: water, electricity, heating, internet and linen. Cleaning (20 €) and the tourist tax are shown separately before payment. Discounts are calculated automatically. Options (early check-in, late check-out) are payable before arrival.
5. Payment
The stay is paid in full before arrival, by card or PayPal when booking (no bank details are stored by the website), or by bank transfer when arrival is far enough away: the dates are then held for 3 days until the transfer is received, otherwise the booking is cancelled automatically. If the stay is changed, any additional amount is paid via the payment link sent, before the change takes effect.
A payment that is rejected, cancelled or wrongly disputed after arrival makes the full price immediately due; the landlord may recover it, with statutory interest from the formal notice.
6. Cancellation
The tenant may cancel from the customer area up to 10 days before arrival: 100% of the amount paid is then refunded to the original payment method. After that, in case of no-show or early departure, no refund is due. If the landlord cancels, the tenant is refunded in full.
7. Right of withdrawal
Under Article L221-28 12° of the French Consumer Code, the right of withdrawal does not apply to accommodation services provided on a specific date.
8. Arrival, departure and end of the agreement
Check-in is from 16:00, self check-in with a personal access code valid only for the stay. Check-out is no later than 10:30, unless a late check-out has been agreed and paid. The agreement ends automatically at the scheduled check-out time, without notice: the tenant and everyone present must then have left with their belongings.
Remaining on the premises after that time without the landlord's written consent is occupation without right or title. It gives rise to an occupancy fee of 150 € per day or part day of delay, plus the costs caused to the landlord (in particular rehousing or refunding the next guests); a court may reduce this penalty (Article 1231-5 of the French Civil Code). The landlord may also ask the prefect for forced eviction (Article 38 of Law No. 2007-290 of 5 March 2007, as amended by Law No. 2026-798 of 18 August 2026), go to court and file a complaint.
9. Use of the premises and serious breaches
The tenant agrees to use the premises peacefully, to follow the house rules, the maximum capacity and the neighbours' peace. Smoking indoors is prohibited, including e-cigarettes.
In the event of a serious breach (undeclared guests, a party, noise reported by neighbours, unlawful use, deliberate damage, subletting), the landlord gives the tenant written notice to stop. If the breach continues or recurs, the agreement is terminated: the tenant must leave within the stated time, without refund of the unused part of the stay, and Article 8 applies.
10. Condition of the premises and damage
The accommodation is handed over clean and in good condition. The tenant reports any problem within 2 hours of arrival, with photos; otherwise the accommodation is deemed compliant. The tenant is liable for damage, losses and abnormal soiling during the stay caused by them or by people they let in; these are charged on proof (photos, quotes or invoices). Exceptional restoration (tobacco smell, party, heavy soiling) is charged in addition to cleaning.
11. Landlord access and insurance
The accommodation is for the tenant's exclusive use during the stay; the landlord or their agent only enters with the tenant's consent, except in an emergency (water leak, fire risk, alarm, danger to people or the building). The tenant must hold civil liability insurance for the stay (holiday cover or home insurance).
12. Complaints, mediation and applicable law
Complaints should be sent to contact@appart.dellys.fr. If no amicable agreement is reached, consumers may use the consumer mediator free of charge: Médiateur fictif (site de démonstration). This agreement is governed by French law.
